To be found guilty of Arson, the D.A. must prove:
- That you set fire to or burned a structure, forest land, or property, AND
- That you did so willfully and maliciously.
A lesser charge to ARSON is ARSON Penal Code 452,
The prosecutor must prove the following two elements:
- You set fire to or burned a structure, forest land, or property, and
- You did so “recklessly.”
- The difference is the “intent” requirement in elements number 2.
