Vehicular Manslaughter occurs when you are driving a vehicle and get into an accident and kill another person. The penalties depend on whether or not drugs or alcohol was involved, and whether or not you were driving in a negligent manner or in a grossly negligent manner. The penalties range from a low of up to one year in the county jail with a maximum of up to 10 years in the state prison for Aggravated Vehicular Manslaughter. If you have been convicted of a DUI and drive again while under the influence of alcohol and drugs and kill someone you can be prosecuted for 2nd degree murder.
